Welcome to Photo Steward (the “App”). By downloading, installing, or using the App, you agree to these Terms and the Photo Steward Privacy Policy. If you do not agree, do not use the App.
## 1. Eligibility
You must have the legal capacity required by applicable law. A minor should use the App only with the permission and guidance of a parent or legal guardian. You may process only content that you own, are authorized to use, or otherwise have a lawful right to access.
## 2. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on Apple devices you own or control.
Apple’s Standard Licensed Application End User License Agreement also applies. If these Terms conflict with mandatory minimum terms required by Apple, the required Apple terms control to the extent of that conflict.
## 3. Version 1.0 Features
The App may provide photo and video grouping, People and Places views, Moments, favorites and album actions, storage trends, recording, contact and calendar organization tools, a locally encrypted Private space, and practical guidance.
Some results depend on device data, permissions, photo metadata, available system resources, and local algorithms. Results may be incomplete, inaccurate, or require time to learn. A storage forecast is informational and is not a guarantee of a date, capacity, or device condition.
## 4. User Choice and Deletion
The App does not delete photos automatically. Favoriting, album creation, photo deletion, contact merge or deletion, calendar-event deletion, and exporting or deleting Private content require an action or confirmation from you.
You are responsible for reviewing selections before confirmation. Photo deletion generally follows Apple Photos Recently Deleted rules. Contact merge or deletion, calendar-event deletion, Private deletion, and recording deletion may not be fully recoverable. Local contact backup and restore features are not a guarantee of a permanent, complete, or error-free backup.
## 5. PIN, Encryption, and Device Security
You are responsible for safeguarding your device passcode and App PIN. We do not possess your PIN or decryption keys and cannot recover a forgotten PIN or guarantee recovery of Private content or recordings after uninstalling, replacing or resetting a device, device failure, corruption, or Keychain changes.
Local encryption reduces some unauthorized-access risks but is not a substitute for device security, reliable backup, and careful sharing. A decrypted copy saved or exported outside the App is no longer protected by Private.
## 6. Permissions and Third-Party Services
Some features rely on Apple Photos, Contacts, EventKit, AVFoundation, the document picker, Keychain, and system sharing. You may deny or revoke permissions, but related features may not work.
Apple, your photo/contact/calendar account providers, and destinations you select for sharing are independent third parties. Their availability, processing, and terms are controlled by those parties, not us.
## 7. Prohibited Conduct
You may not:
- violate law or another person’s privacy, intellectual property, or other rights;
- access, import, copy, delete, or share another person’s content without authorization;
- bypass security, interfere with operation, distribute malicious code, or attempt unauthorized system access;
- reverse engineer, rent, resell, sublicense, or commercialize the App except where applicable law expressly permits; or
- use the App for fraud, harassment, surveillance, or other harmful conduct.
## 8. Intellectual Property
You retain the rights you lawfully hold in your content. Intellectual property in the App, including its interface, text, graphics, code, and trademarks, belongs to us or the relevant owner. These Terms do not transfer those rights to you.
You authorize the App to process your content on device only as necessary to perform the features you choose. We do not obtain permission to use your content for advertising or to train server-side models unless you separately and affirmatively agree in the future.
## 9. Updates, Changes, and Termination
We may update, change, or discontinue features for security, compatibility, performance, legal compliance, or product improvement. We will provide reasonable information about material changes. You may stop using and uninstall the App at any time.
If you materially violate these Terms or law requires it, we may limit applicable services or terminate the license where permitted. Because version 1.0 has no account or remote service, we generally cannot remotely access or delete local content on your device.
## 10. Disclaimers
To the maximum extent permitted by law, the App is provided “as is” and “as available.” We do not warrant that grouping, face clustering, duplicate identification, contact merging, calendar filtering, storage forecasts, backup records, or restoration results will be accurate, complete, uninterrupted, or suitable for every purpose.
The App is not a professional backup, forensic, secure-custody, medical, legal, or financial service. Review selections and maintain an independent backup before irreversible actions.
Some jurisdictions do not allow the exclusion of statutory warranties. This section does not affect rights that cannot lawfully be excluded.
## 11. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, punitive, or consequential losses arising from use of or inability to use the App, including content loss, contact or calendar changes, lost profits, or business interruption.
Where a limitation is not permitted, liability is limited to the maximum extent allowed by law. Nothing excludes liability for fraud, willful misconduct, personal injury, or another liability that applicable law does not permit us to limit.
## 12. Governing Law and Disputes
These Terms are governed by the laws of [Governing Law and Jurisdiction], without regard to conflict-of-law rules. The parties should first try to resolve a dispute informally. Unresolved disputes will be submitted to a court or lawful dispute-resolution body with jurisdiction. Mandatory consumer venue and remedy rights remain unaffected.
## 13. Changes to These Terms
We may update these Terms and will post the new effective date. We will provide an appropriate notice for material changes. Where law requires separate consent, we will request it.
